Chennai: A city magistrate court extended an arrest warrant against filmstar Rajnikanth's wife Latha Rajinikanth and daughter Soundarya Rajnikanth on Wednesday, but recalled it after the financial dispute was settled out of court.
The bailable warrant was issued by XXIII Metropolitan Magistrate court in Saidapet on a complaint filed by businessman Sumerchand Bafana of Teynampet. According to the complainant, Soundarya and Latha Rajinikanth had obtained a loan of Rs 20 lakh from him for business exigencies in August 2009. They issued two cheques, dated December 1, 2010, towards repayment. But the cheques were dishonoured by the bank. Bafana filed a complaint on December 24, 2010 at the magistrate court.
Taking his complaint on file on January 6, 2011, the court ordered summons to Soundarya and Latha, directing them to appear before it on January 19. As they did not appear on that day, the court ordered issuance of a bailable warrant against them and adjourned the matter to Wednesday.
They did not turn up even when the matter came up for hearing on Wednesday morning, following which the case was posted to March 9 for execution of the warrant.
However, later in the day, the complainant filed a petition stating that the matter had been settled out of court and sought permission of the court to withdraw his complaint. Accepting it, the court, under section 257 CrPC, dismissed his complaint as withdrawn and also recalled the arrest warrants issued by it.
In its order, the court said it had dismissed the complaint as withdrawn as reason for seeking withdrawal was acceptable and justifiable.
